JFK joins hands with The Sentinel Law-ICRPR to fight Unlawful detention:

The Sentinels of justice, Institute of Civil Rights and Policy Reforms (ICRPR) – a public charitable trust, is a group of lawyers and social activists, practitioners and technocrats committed to nurture and support the idea of an equitable, non-discriminatory and self-sufficient society

PURPOSE OF THE PROJECT

 “Set Them Free” Project (here-in-after the “STF”) is an extensive effort to revisit the policies and statutes governing the functioning of prisons in the state of J&K and the condition of prisoners thereof. The Project is multidimensional – while one aspect aims at working in the field to ensure rights of the prisoners are enforced by taking up cases of prisoners (except rape and allied crimes) and other aspect of it is concerned with research and data collection. The ultimate aim of the STF is to prepare a suggestive dossier on the desired prison reforms, which will be presented to various stakeholders on the project completion and provide free legal aid to maximum number of detainees.

OBJECTIVES

The main objectives of STF Project are:

  • Prepare representations and petitions including Public Interest Litigation petitions and Habeas Corpus petitions to be filed before the concerned authorities and the Hon’ble High Court of J&K respectively to ensure that all prisoners receive a fair trial and that their rights are protected.
  •  Provide comprehensive legal aid to the under-trials and inmates, right from applying for their bail to the conclusion of trial and even filing appeals against convictions, if any.
  • Raise a general awareness about the condition of the jails of the state and an immediate need of improvement.
  • Advocacy programs for prisoner rights and legal action against the denials thereof by the state.
  • Prepare and maintain a database of the prisoners, which would include the cause of incarceration, time of detention, whether charged or detained without any charge, etc.
  • To be the primary referral for all the prisoner’s rights issues and repository of jail and detention information, should any person or organization require it.
  • Prepare a detailed dossier on the laws and policies governing prisons in J&K at present and the overall set-up of such institutions including but not limited to the strength of the staff, number of people incarcerated, annual funding of the prisons, reformative programs at these prisons, conditions of inmates, medical and other facilities available, etc.

AN INSIGHT OF THE PAST WORK OF SENTINEL LAW FIRM-

The case pertained to arrest of people on 12-10-2015, the police party were patrolling the Nowgam chowk near Ahli Hadees masjid in the area of Srinagar , wherein a crowd of people gathered on the roads and streets and blocked the roads with lathis in their hands and started throwing stones on the policemen and even damaged public and Government vehicles as per the police version . On this day The Traders Federation of Kashmir had given a strike call. Due to this violence some policemen were injured including, SI Mohd. Mukhtar 1349/s, (2, Head constable Gh. Qadir 1436 (3, SG Constable Irshad Ahmad 3855 (4, SG constable Mohammad Farooq 3060.

Eleven persons were arrested and FIRs had been lodged against them. The Sentinel Law intervened in the month of March 2018 and was able to get acquittal of 9 persons mentioned herein below through its Senior Legal Counsel Ms. Mahira Bhat, availing  all the legal provisions and state announced amnesty in favour of the accused persons.

In another such incident 3 persons were acquitted who were arrested on 9-04-17 at 15:30 pm (Mahjoor Nagar Police Station), Srinagar under supervision of Shri Kuldeep kumar 708/CR ASI who was patrolling in the area of Ram Bagh, Mahjoor Nagar. The officer and other policemen were attacked by the mob and started pelting  stones on the police party and also damaged some vehicles. Aqib Makroo also took part in the violence. To disperse the mob the police used tear gas shells. Aqib Makroo one of the stone pelter was arrested and charge sheet was filled U/S 147,148,149,323,427/RPC against them.
